Dave Gaouette tells the Denver Post they lacked the evidence to prove the 2002 charge against the radical cleric sought for advice by Fort Hood killer Nidal Malik Hasan. Gaouette, who was an assistant U.S. attorney at the time, responded to an ABC News report earlier this week which said agents were outraged by the decision.
