Steve Emerson comments are spot on.

This is a huge mistake and will have a terrible negative effect on the Western Democracies ability to win the war on terrorism. I am afraid the present administration in Washington just don't get it. You can't prosecute terrorists through our judicial courts.What are they thinking?
